Companies who repeatedly commit the same violations shall be penalized with the corresponding fine plus an additional fine equivalent to 50% thereof for every instance of repeat violation. On the other hand, committing the following acts shall be penalized with an additional P100,000.00:

Repeated obstruction, delay or refusal to provide the DOLE access to the covered workplace or refusal to allow access to relevant records and documents necessary in determining compliance with OSH standards;

Misrepresentation in relation to adherence to OSH; or

Retaliatory measures such as termination of employment, refusal to pay, reduction of wages and benefits or any form of discrimination against any worker who has given information relative to the inspection being conducted.
